If you are injured at work, the first thing you should do is notify your supervisor or business owner immediately. Then file a Worker's Compensation claim and request to see a physician. Your employer will chose a physician to diagnose and treat you. There is waiting period of three business days after you file a claim with the worker's Comp Administration before you can receive Worker's Compensation benefits from your employer's insurer. Compensation for your disability is retroactive if it continues for 14 days after the date of your injury. If medical treatment or temporary benefits will continue past thirty days, a report of medical expenses and benefits paid must be filed within thirty days of the original date of notification of the injury.  Â
Types of workers compensation benefits available include:
Payments of benefits are made based on a percentage of the original wage and they are subject to weekly minimum and maximum payment amounts.  Payments for PTD continue for the period of the disability. Payments for TTD and PPD could continue for a maximum of 400 weeks. Death benefits are subject to a cap and are payable to the surviving spouse and/or children. There is a minimum death benefit regardless of the deceased's earnings.  An allowance for burial and funeral expenses is also available for the surviving family.
